The pop singer visited the country this week with the hope of taking Mercy home after she filed adoption papersfor the child, but her application was denied by the Malawi’s High Court this morning, AFP reports.

At a closed-door hearing, Judge Esmie Chondo said: “I must have to decline to grant the application to Madonna.

“By removing the very safeguard that is supposed to protect our children, the courts by their pronouncements could actually facilitate trafficking of children by some unscrupulous individuals who would take advantage of the weakness of the law of the land.”

She added: “I must confess that there’s a gripping temptation to throw caution to the wind and grant an adoption in the hope that there will be a difference in the life of just one child.

“However, it should be borne in mind that inter-country adoptions may not be and are not the only solution.”

It is believed that the reason for the rejection was a law requiring adoptive parents to be resident in the country for 18-24 months, though these regulations were waived when Madonna adopted David Banda from Malawi in 2006.

Madonna’s lawyer had previously said that there was no law in Malawi which could stop her adopting a second child from the country.
